TotShelf grants you a limited, revocable, non-exclusive, non-transferable license to access and make personal non-commercial use of the Services. TotShelf reserves the right to prohibit any conduct involving the Services that it deems to be in violation of these Conditions of Use, in its sole reasonable discretion. If you are creating a TotShelf account, you affirm that you are at least 13 years of age and acknowledge that an TotShelf account is not intended for creation and use by individuals under 13 years of age.

You are granted a limited, revocable, non-exclusive, non-transferable right to create a hyperlink to the Services so long as the link does not portray TotShelf, our suppliers, or our products or services in a false, misleading, derogatory or otherwise offensive manner. To access the TotShelf Services, you may download and use the TotShelf app which is proprietary (collectively referred to as “Software”).
Use of the Software is governed by the terms of an end user license agreement (“EULA”), which is expressly included in these Conditions of Use. An end user must agree to the EULA, which accompanies or is included with the Software, to install and/or access any Software. The Software is made available for download or access solely for use by end users according to the EULA.

The laws of copyright protect the Content that is made available through the Software and associated Services. Copyrights in the Content are held by their respective owners. You are not granted any synchronization, public performance, promotional use, commercial sale, resale, reproduction and/or distribution rights for the Content. You shall not download and/or save Content on public Internet terminals, shared devices, and/or public computers without prior written permission from TotShelf.
TotShelf LLC, www.totshelf.com, and the Services and/or Software are either registered trademarks, trademarks, trade names, service marks, or otherwise protected property of TotShelf and may not be used, copied or imitated without prior written permission from TotShelf.
All content included in or made available through any TotShelf Service, such as text, book recommendations, data compilations, and software is the property of TotShelf or its content suppliers and protected by United States and international copyright laws. Exception to this is the read-out link provided for each book recommendation. TotShelf LLC does not own rights to these read-aloud videos - it has only been provided as reference for the users. All graphic content included in or made available through any TotShelf Service, such as text, graphics, logos, button icons and images is licensed to TotShelf by Anita Liz Studio. The compilation of all content included in or made available through any TotShelf Service is the exclusive property of TotShelf and protected by U.S. and international copyright laws.
THE TOTSHELF SOFTWARE AND SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, TOTSHELF DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND DUTIES, WHETHER EXPRESS OR IMPLIED, REGARDING THE OVERDRIVE SOFTWARE AND ANY TOTSHELF SERVICES, INCLUDING, WITHOUT LIMITATION, ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, RESULTS OF USE, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. When you use TotShelf Services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices (, or notices and messages on this site / app) and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

TotShelf attempts to be as accurate as possible. However, TotShelf does not warrant that book descriptions or other content of any TotShelf Service is accurate, complete, reliable, current, or error-free. If a book suggested by TotShelf itself is not as described, you may contact TotShelf to correct the book description.
When you use the TotShelf App you may grant certain permissions to us for your device. Most mobile devices provide you with information about these permissions.
TotShelf may email you about authors, digital content titles, services, special offers, and other information you elect to receive from TotShelf. No association with nor endorsement of any third-party digital content, websites, products, and/or services is intended or implied by TotShelf emailing you such information. You may opt out of these communications at any time by changing your TotShelf account preferences.

If you wish to submit a request for us to permanently close your TotShelf account and delete your personal information, please email us at help@totshelf.com
A confirmation notification will be sent to the email address associated to your account or via text message. You’ll need to reply within 5 days to verify your request.
Once your account is closed, it is no longer accessible by you or anyone else, and it cannot be restored. If you decide later that you want to use TotShelf app again, you’ll need to create a new account.
TotShelf reserves the right to modify, suspend or discontinue the Services (or any part thereof), Software, or any Content (or any part thereof) at any time with or without notice to you. TotShelf shall not be liable to you or any third party should we exercise such right.
After 30 days of your account deletion request, your account and all your information will be permanently deleted, and you won't be able to retrieve your information. During those 30 days the content remains subject to TotShelf's Terms of Use and Privacy Policy and is not accessible to other people using TotShelf. It may take up to 90 days to complete the deletion process after it begins. Copies of your content may remain after the 90 days in backup storage that we use to recover in the event of a disaster, software error, or other data loss event. We may also keep your information for things like legal issues, terms violations, or harm prevention efforts. Learn more about this in our Privacy Policy.

The Services and Software are owned by TotShelf LLC. Visitors who choose to use our Services and Software from other jurisdictions do so on their own initiative. Those visitors are solely responsible for compliance with all laws, rules, and regulations, federal, state, local or foreign, applicable to the use of this website and information, content, material and services contained herein.
These Conditions of Use shall be governed by the laws of the State of California, without regard to any conflict of laws principles. Any dispute regarding these Conditions of Use or the relationship that has been established by these Conditions of Use shall be brought in the state or federal courts residing in the State of California, United States of America, and the local laws of California will apply to any such action related to the above without regard to any conflicts of laws principles.
